Payment Authorization Terms and Conditions

Welcome to the secure payment technology service provided by Paymentus Corporation (“Paymentus”). We are an authorized provider for Credit Acceptance Corporation (“Credit Acceptance”). If you use this service to make your payment to Credit Acceptance, you accept these terms and conditions. Please read them carefully.

For each online payment you authorize to Credit Acceptance, Paymentus will charge a $3.95 technology-service fee. This fee will appear on your bank account or card statement as an additional transaction. Your bank or card issuer may also assess fees or charges related to the payment. Paymentus is not involved in the administration or collection of your account with Credit Acceptance. Credit Acceptance posts payments to your Credit Acceptance account the same day if submitted through Paymentus by 11:45 p.m. Eastern Time. This means you may see the payment posted on your Credit Acceptance account before the payment has been charged to your card or debited from your bank account. It is your responsibility to ensure the funds are available at the time the payment is presented to your financial institution, which typically occurs within two (2) business days of the date you submitted the payment. If there are insufficient funds in your bank account or on your card, or if the payment is declined when it is presented to your financial institution, then the payment will be reversed on your Credit Acceptance account. Payments scheduled for a future date will be posted to your Credit Acceptance account on the day you have scheduled for the payment.

Maximum Payment Amount: The most you may submit for payment at any one time is $2500.00. If you wish to submit payment for more than $2500.00, you may submit multiple consecutive payments.

Refund Policy: Except as required by law, you may not cancel a Payment once it has been posted to your Credit Acceptance account. Except as required by law, there are no refunds of the Credit Acceptance payment or the Paymentus technology-service fee after your card or bank account has been charged or debited.

Acceptance: By submitting a payment using this service you agree to pay the Total Payment amount that you have instructed us to charge to your card or debit from your bank account, including the Credit Acceptance Payment Amount and the Paymentus Technology-Service Fee. All authorizations are subject to the agreements governing your card or bank account. The payment transactions will only be completed after receiving successful authorization from your financial institution for the Total Payment amount.

Limitation of Liability: You agree that Paymentus’s liability for any delay, failure of delivery, underpayment, or nonpayment is limited to the technology-service fee paid to Paymentus for the use of this payment technology service. In no event shall Paymentus be liable for any direct, indirect, incidental, consequential, or punitive damages. You agree further that Paymentus shall not be liable for any damages whatsoever for its failure to process transactions from prohibited third parties.

Prohibited Use: This payment service shall only be used by Credit Acceptance customers, or customer authorized third-parties. Third party commercial payors and/or payment aggregators are expressly prohibited from submitting payments through Paymentus’s secure payment technology; any and all use of the Paymentus technology platform is prohibited, whether web-based, IVR, or Credit Acceptance agent interfaces. By using the Paymentus secure payment technology, you represent and warrant you are (i) a customer of Credit Acceptance paying on your own Credit Acceptance account, or an individual authorized by a Credit Acceptance customer to pay on the Credit Acceptance customer’s account, and (ii) you are not using the Paymentus Technology Platform for commercial gain. You agree that any breach of these warranties constitutes a material breach of this Agreement. Paymentus reserves the right to reverse any and all payments made from third party agencies, and you agree to: (i) indemnify Paymentus for interchange fees, merchant fees, as well as all other costs and fees, including internal costs to Paymentus to research and compile charges by you incurred in processing a payment transaction in violation of these Terms and Conditions, and (ii) indemnify Paymentus for all other damages, costs, fees, expenses, and attorney fees resulting from your breach of this agreement.

Compliance with Law: You represent and warrant that your use of the Paymentus secure payment technology shall not violate any law, statute or regulation involving money laundering, or any other illegal activity. The Paymentus secure payment technology, including but not limited to websites, IVR systems, and Credit Acceptance agent interfaces belong to Paymentus. All intellectual property contained in those platforms are owned by Paymentus. You further agree that you will utilize the platform solely for payment of a debt and will not utilize or introduce to the Paymentus secure payment technology any automated program or device such as a robot, spider, or scraper for any reason including, without limitation, for the purpose of paying bills, copying the platform or otherwise obtaining information about the platform, including any automated payment paradigm.

Miscellaneous: If any one or more of these Terms and Conditions shall for any reason be held to be invalid, illegal or unenforceable, the remaining provisions shall remain valid and enforceable.

Terms and Conditions Changes: We reserve the right, in our sole discretion, to amend these Terms and Conditions at any time by making the amended terms available through the Credit Acceptance online Customer Portal, and all amended terms shall be effective immediately upon becoming available in the Customer Portal.
